A. Right of Withdrawal 

Introduction

Consumers have the right of withdrawal according to the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributed to their commercial or self-employed professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reasons.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (GEMCore), Ruhrallee 9, 44139 Dortmund, Germany, Tel.: 0231 13099086, Email: office@gemcore.ai) with a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient for you to send the notice of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (excluding the additional costs arising from your choice of a different type of delivery than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which the notice of your withdrawal from this contract has been received by us. We will use the same payment method for this reimbursement that you used for the original transaction unless we have expressly agreed otherwise with you; in no case will you incur any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any diminished value of the goods if this diminished value is due to handling them in a way that is not necessary for checking their nature, properties, and functioning.
